AGREEMENT BETWEEN CUSTOMER AND BOXCUBE TRAVELLERS (M) SDN BHD

This website is operated by Boxcube Travellers (M) Sdn Bhd (Company Registration No. 201301035082 (1064910-H)| KPK/LN 10237). Its purpose is to assist customers in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations, or conducting business with travel suppliers. The terms "we," "us," "our," and "Boxcube Travellers" refer to Boxcube Travellers (M) Sdn Bhd. The term "you" refers to the customer visiting the website and/or booking a reservation through us on this website.
Your use of this website is subject to your acceptance, without modification, of all the terms, conditions, and notices set forth below (collectively referred to as the 'Terms of Use' or 'Agreement'). Please carefully read the Terms of Use. By accessing or using this website, booking any travel products or services through this website, or contacting our customer service, you agree that the Terms of Use then in force shall apply. If you do not agree to the Terms of Use, please refrain from using this website or making bookings through our customer service. Boxcube Travellers reserves the right to change these Terms of Use at any time, and your continued use of this website is conditioned upon the acceptance of the updated Terms of Use.
The services provided by Boxcube Travellers, as defined below, can only be utilized by customers who have read and unconditionally accepted these General Terms and Conditions. The booking process cannot proceed without this acceptance. Customers commit to fulfilling the obligations outlined in these terms and conditions. The agreement between the customer and Boxcube Travellers takes effect as soon as Boxcube Travellers provides written confirmation of a booking to the customer via email.
Customers are assumed to have read, comprehended, and accepted the following. It is advisable to save and/or print a copy of these terms and conditions for future reference when making a booking.
1. BOOKING AGREEMENT
Your booking is considered confirmed, and a contractual agreement is established when Boxcube Travellers issues a written confirmation upon the receipt of the applicable deposit amount. We urge you to carefully review your confirmation and promptly report any inaccuracies or incomplete information to Boxcube Travellers.
2. BOOKING ON BEHALF OF OTHERS
If you make a booking on behalf of other participants, you assume the role of the designated contact person for each participant included in that booking. This entails the responsibility for all payments associated with your booking, as well as the obligation to promptly notify Boxcube Travellers of any changes or cancellations.
It is your duty to secure all necessary consents and to ensure that any information provided on behalf of another participant is complete and accurate when conveyed to Boxcube Travellers.
3. AGE REQUIREMENT
The age limit for participation in any travel package(s) or services provided by Boxcube Travellers is 1 to 75 years old. Participants under the age of 18 are considered minors, with children aged 2 to 12 years and infants below 2 years. Minors, children, and infants must always be accompanied by an adult.
The accompanying adult is responsible for obtaining all necessary consents, documentation, and ensuring that both they and the minor(s), children, and infant(s) meet all legal requirements for travel, entry, and departure from applicable countries and regions. Boxcube Travellers will not be held responsible for any fees, damages, or losses incurred due to a failure to secure the required consents, permits, and approvals.
Each adult included in a booking with minor(s), children, and infant(s) is accountable for the behaviour, well-being, supervision, and monitoring of such minor(s), children, and infant(s). Moreover, each adult accepts these Terms and Conditions on behalf of any minor(s), children, and infant(s) on their booking, encompassing all assumptions of risk and limitations of liability.
4. SPECIAL REQUIREMENT
All special requirements must be communicated to Boxcube Travellers at the time of booking. While we will make reasonable efforts to accommodate your special requests, this may not always be feasible and depends on the availability of options.
For food allergies and dietary restrictions, it is essential to disclose them to Boxcube Travellers at the time of booking. However, we cannot guarantee that all dietary needs or restrictions can be accommodated. Please note that certain requirements and requests may result in additional charges.
It is important to recognize that any special requests or requirements do not constitute a part of these terms and conditions. Boxcube Travellers is not held liable for any inability to accommodate or fulfil such requests.
5. CURRENCIES, PRICE AND TAX

5.1. The default currency for all travel package(s) and service(s) is the Malaysian Ringgit (MYR), and transactions through the payment gateway will be processed in Malaysian Ringgit. Prices displayed in alternative currencies are provided for reference purposes only and are subject to the exchange rate determined by your bank, including any transaction fees imposed by the bank or other processing agencies. As a result, the amount shown on your credit or debit card statement may differ from the figure presented during the reservation process on this website. If you have questions regarding these fees or the applied exchange rate for your booking, we suggest reaching out to your bank or credit card issuer for clarification.
5.2 The rate for each package and service will be provided as a per-person quote unless stated otherwise.
5.3 Price quotations are subject to change without prior notice until a booking has been confirmed.
5.4 Unless specified otherwise in the travel package or services, prices do not include any local taxes or use fees, such as foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger facility charges, or international transportation tax.
5.5 Prices exclude tips/gratuities, passport and visa fees, baggage and personal insurance, any personal items, taxes or duties, and any beverages or food not expressly stated as included in the package or services.
5.6 The price of the Travel Package(s) and any products or services offered by Boxcube Travellers is subject to change at any time. We reserve the right to impose surcharges on any Travel Package(s) and any product(s) or service(s) booked due to increases in transportation costs, fuel costs, taxes, airport charges, local operator costs, currency and exchange rate fluctuation, or government actions affecting the price of the applicable package(s) or service(s).
If the price changes after you receive the confirmation and full payment has been made, you may choose to either:
(a) Cancel the booking without any charges, or
(b) Accept the change of price.
You must notify Boxcube Travellers of your choice before the tour or at least 7 days after receiving notification of the price change. Failure to provide notification will be deemed as acceptance of the price change, and you will be liable for payment of the increase. Boxcube Travellers may offer reduced pricing on certain products or services, applicable only to new bookings. Bookings with at least a received deposit are not entitled to reduced pricing.
6. DEPOSIT AND FINAL PAYMENT
Upon confirmation of services, a deposit of 50% is mandatory. The remaining balance or full payment must be settled within 14 days before the scheduled service. It is important to note that bookings are not considered confirmed or secured until Boxcube Travellers receives the deposit and issues a written confirmation to you.
For bookings made within 14 days or less before the scheduled arrival, full payment is required at the time of booking.
Failure to adhere to these payment terms may lead to the cancellation of the reservation and forfeiture of the deposit. Boxcube Travellers disclaims responsibility for cancelled land and/or air reservations if full payment is not received by the final payment date.
7. MODIFICATIONS OR CANCELLATIONS BY GUEST

7.1 All amendments and cancellations must be notified to, received and acknowledged in writing by Boxcube Travellers.
7.2 Boxcube Travellers reserves the right to impose a RM60.00 administrative fee for any amendment made by clients to a confirmed booking or related services.
7.3 Any cancellation charges imposed by third-party suppliers such as hotels, restaurants or any other companies related to the services required, will be billed to you through Boxcube Travellers.
7.4 If we receive booking cancellation prior to the booking, the cancellation fee, if any will be determined with reference to the date on which notice of cancellation received by Boxcube Travellers is based on the percentage of the total price for the cancelled tour(s), products or services.
The cancellation charges are as follows:-

25% cancellation fee for notification of cancellations made 31-60 days before service

50% cancellation fee for notification of cancellations made 15-30 days before service
-
100% cancellation fee for notification of cancellations made 14 days or less before service
8. CANCELLATION OF TRAVEL PACKAGES OR SERVICES BY COMPANY
The company holds the flexibility to adjust or modify itineraries, travel arrangements, hotel accommodations, or withdraw the services of a tour as needed due to circumstances beyond the operators' control. We reserve the right to cancel a tour if there are insufficient passengers or uncontrollable factors that might compromise the safe execution of the tour or the delivery of services outlined in the itinerary. Unforeseen circumstances such as acts of God, war, transportation strikes, civil strikes, pandemics, endemics, and government orders from Malaysia or other countries may necessitate tour cancellation.
In the event of tour cancellation, we are committed to providing you with appealing alternative tours, preferably to the same destination or similar alternatives. If you opt not to accept the alternative tour, we will make every effort to fully refund all payments made, always in accordance with the refund policies of our partners. If the cancellation is due to factors like insufficient passengers or the inability to secure seats or accommodation, we assure you a prompt and complete refund of the entire amount paid. Your satisfaction and safety are of utmost importance to us.
9. REFUND OF UNUSED OR MISSED SERVICES
Boxcube Travellers will not provide reimbursements, discounts, or refunds for services that go unused or are missed after the tour departure, especially if such situations arise due to factors beyond the control of Boxcube Travellers. This includes instances where participants are removed from a tour due to their negligence or a breach of the Terms and Conditions.
